Utah Legislature Repeals Part of Internet Censorship Law - In response to a constitutional challenge mounted by CDT and others, the Utah legislature this week passed a bill that repeals portions of the state's controversial Internet censorship law. In 2005, CDT, the American Civil Liberties Union of Utah, and a broad coalition of bookstores, independent artists, trade associations and ISPs challenged the censorship law, which would have required ISPs to block access to vast amounts of constitutionally protected Internet content. The groups obtained a preliminary injunction against the Utah law in 2006. Although the enactment yesterday of House Bill 5 rightly repeals some of the most problematic aspects of the Utah law, the legislature left other unconstitutional parts of the law intact, so the litigation pending in federal court in Salt Lake City will continue.
